2. Section 10 guide

2.1In terms of section 10 of the Promotion of Access to Information Act No. 2 of 2000, the South African Human Rights Commission has published a guide containing information relating to:

2.1.1obtaining access to a record of a private body and the assistance that is available from the South African Human Rights Commission in this regard;

2.1.2lodging a court application against a decision by the head of a private body;

2.1.3the fees that are payable for accessing a record; and

8. Planned recipients of personal information

We give the following people personal information that we process in the ordinary course of business to fulfill our obligations to our customers or clients:

9. Planned trans-border flow of personal information

9.1We may send personal information outside South Africa to various countries. We will only transfer data to other countries who have similar privacy laws to South Africa's or to recipients who can guarantee the protection of personal information to the same standard we must protect it.

10. Security

10.1We secure our data by maintaining reasonable measures to protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction. We also take reasonable steps to keep personal information accurate, current, complete and reliable for its intended use.

11. The request procedure

11.1Forms and fees

11.1.1A request for information must be made in the prescribed form, must be addressed to the Information Officer and must be submitted with the prescribed fee.

11.1.2The prescribed request form and details regarding the prescribed fees are available from the South African Human Rights Commission, whose contact details are set out in this document. The prescribed request form and prescribed fee details are available on the website of the Department of Justice and Constitutional Development at www.doj.gov.za.

11.2Form of request

11.2.1The requester must use the prescribed form to make the request for access to a record. This request must be made to the address, facsimile number or electronic mail address of the Information Officer and must contain the requester's postal address and facsimile number within the Republic.

11.2.2The requester must provide sufficient detail on the request form to enable the Information Officer to identify the record requested and the requester. The requester should also indicate which form of access is required. The requester should indicate if notice of the decision of the Information Officer is required in any manner, other than in writing, and if so, the necessary particulars to be so informed.

11.2.3In the request form, the requester must identify the right that is sought to be exercised or to be protected and provide an explanation of why the requested record is required for the exercise or protection of that right.

11.2.4If a request is made on behalf of another person, the requester must submit proof of the capacity in which the requester is making the request to the satisfaction of the Information Officer.

11.3Fees

11.3.1A requester who seeks access to a record containing personal information about that requester is not required to pay the request fee. Every other requester, who is not a personal requester, must pay the required request fee.

11.3.2The Information Officer must by notice require the requester to pay the prescribed fee, if any, set out in the notice, before further processing the request.

11.3.3The requester may lodge an application with a court against the payment of the prescribed request fee.

11.3.4After the Information Officer has made a decision on the request, the requester must be notified in the required form.

11.3.5If the request is granted then a further access fee must be paid for the search, reproduction, preparation, and for any time, in excess of the prescribed hours, required to search and prepare for the record disclosure.

12. Remedies

If request for access is denied, the requester may:

  • apply to a court with appropriate jurisdiction, or
  • lodge a complaint with the Information Regulator, for the necessary relief.

13. Availability of the manual

13.1This manual is available for inspection by the general public upon request during office hours and free of charge at Synergy Evolution's physical address as well as on Synergy Evolution's website, www.synergyevolution.co.za.

14. Updates to this manual

14.1This manual will be updated whenever we make material changes to the current information.
